On November 26, 2013, the Supreme Court agreed to hear two
cases that involve for-profit corporations. The Court agreed to hear a case
from the Tenth Circuit Court of Appeals, <a href="http://www.bloomberg.com/news/2013-11-26/health-law-s-birth-control-rule-gets-supreme-court-review.html" target="_blank">which ruled in favor of Hobby Lobby</a>, an Oklahoma-based chain of craft stores
owned by a Christian family who claim that the contraceptive coverage
requirement violates their company’s religious freedom. The Court also agreed
to hear a case from the Third Circuit Court of Appeals, which ruled against the
corporation and its owners, finding that <b style="mso-bidi-font-weight: normal;">Conestoga
Wood Specialties</b>, a cabinet manufacturer, does not have religious rights.</div>

The Supreme Court determined that for-profit corporations
have protections under the 1993 Religious Freedom Restoration Act (RFRA). In
its June, 2014 ruling the Supreme Court of the United States determined that
the Affordable Care Act (ACA) violated RFRA<span style="mso-spacerun: yes;">
</span>interpreting the “employer” as a “person” capable of religious belief.
The Court also determined that the owners rights were violated by a government
regulation imposed on the corporation. </div>

The legal entity of a corporation is broadly defined as a “person”
and therefore have First Amendment rights. The Supreme Court ruled that the
government did not meet its healthcare mandate in the least restrictive way.
The future implications to this ruling are broad and could lead to future
challenges with broadened ramifications for civil rights protections in the
workplace. Currently, an employer can be fined if they do not offer affordable
health coverage with the 12 essential benefits as stipulated in the Affordable
Care Act of 2010 (ACA). There are currently over 40 cases pending which
challenge the Act. Small employers with less than 50 full time equivalent
employees are exempt from the ACA. Large employers will start to receive penalties
for non-compliance beginning in 2015.</div>

is an important career choice for many people. But with this choice comes the
need to provide your own health insurance, which can be a formidable expense.
The new health care legislation signed into law by President Obama should make
it easier for individuals to purchase health insurance. Until all its
provisions take effect, if you are self employed and are seeking health care
coverage, here are four options.<o:p></o:p></span></div>
<ol start="1" type="1">
<li class="MsoNormal" style="color: #333333;"><b><span style="font-family: "Verdana","sans-serif"; font-size: 10pt;">Join your
spouse's plan.</span></b><span style="font-family: "Verdana","sans-serif"; font-size: 10pt;"> If you have a spouse or partner who is or can be
enrolled in an employer-sponsored plan, joining his or her plan is usually
the simplest and least expensive way to maintain coverage. Nearly all
employer-based plans offer coverage to spouses and children, and many
provide coverage to domestic partners as well.<o:p></o:p></span></li>
<li class="MsoNormal" style="color: #333333;"><b><span style="font-family: "Verdana","sans-serif"; font-size: 10pt;">Look into
COBRA coverage.</span></b><span style="font-family: "Verdana","sans-serif"; font-size: 10pt;"> If you formerly worked for an organization that
employed 20 or more people and made a group health plan available to
employees, you may be able to obtain medical coverage through the federal
Consolidated Omnibus Budget Reconciliation Act, known as COBRA. COBRA
requires employers to make available to departing employees the option of
continuing membership in an employer-sponsored group medical plan at the
employee's expense. You can continue your health insurance under COBRA for
yourself and your dependents for 18 months, during which time you can
search for the best option as a self-employed person.<o:p></o:p></span></li>
<li class="MsoNormal" style="color: #333333;"><b><span style="font-family: "Verdana","sans-serif"; font-size: 10pt;">Check out
high-deductible plans.</span></b><span style="font-family: "Verdana","sans-serif"; font-size: 10pt;"> Another option is to enroll in a
high-deductible health plan (HDHP) and fund a health savings account
(HSA). As the name suggests, high-deductible health plans involve a high
deductible or threshold, a minimum of $1,200 for an individual and $2,400
for a family in 2011, below which you must pay all costs. In essence, a
high-deductible policy provides coverage for catastrophic situations but
not for regular doctor visits and routine care. Such plans can involve
complex cost-sharing arrangements in which certain procedures or visits are
covered only in part. When considering this option, factor in not only
monthly premiums but also the costs of partial out-of-pocket payment for
different procedures. Combining an HDHP with a tax-free health savings
account can also save you in taxes. You deposit pre-tax dollars into your
HSA, and use that money to pay medical expenses that aren't reimbursed by
your health insurance.<o:p></o:p></span></li>
<li class="MsoNormal" style="color: #333333;"><b><span style="font-family: "Verdana","sans-serif"; font-size: 10pt;">Investigate
coverage through a professional association.</span></b><span style="font-family: "Verdana","sans-serif"; font-size: 10pt;"> A more
cost-efficient option may be to enroll in a group plan through a
professional association or union. Check with any affiliations you may
have (or inquire about any you can join) and ask about group rates for
members.<o:p></o:p></span></li>
</ol>
<span style="font-size: 10pt;">When shopping for the right plan, make sure
to compare premiums, coverage, deductibles, and copays. Also keep in mind that
after you turn 65, you may be eligible for Medicare, even if you remain
self-employed.</span><br />

it's a difficult subject to talk about, it's also a topic that often generates

Consider this: The average cost of nursing home care in the United States now
exceeds $70,000 per year, with wide ranging variations from state to state.<sup>*</sup><o:p></o:p></span></div>

</span><span style="color: #333333; font-family: "Verdana","sans-serif"; font-size: 10pt; font-weight: normal;">For the most part, those who need long-term
care are left to foot the bill on their own. Neither Medicare, nor Medicare
supplemental coverage ("Medigap"), nor standard health insurance
policies cover long-term care unless you are impoverished. That's why long-term
care insurance is so important. Since premium costs are based on your age and
health at the time of purchase, the younger and healthier you are when you
purchase a policy, the lower the premium you're apt to pay during the life of
the plan.<br />

By building your nest egg, you're planning for the comfortable retirement you always hoped for. All it takes to plan for the unfortunate event that something unexpected happens on the way to retirement is to name beneficiaries for all your investments. While it may seem easy to overlook now, the effort may be greatly appreciated by your heirs.<br />

By naming a beneficiary, you're ensuring that your money goes where you want it to go when you die. Employer-sponsored plans are unique in that they generally require that a spouse is the primary beneficiary, unless you elect otherwise and your spouse consents in writing. But other investments, such as individual retirement accounts (IRAs), may not provide this automatic feature.<br />

You may choose to name more than one beneficiary for a particular account. However, you will need to specify the percentage each beneficiary is to receive. If you don't, your assets will be divided equally among your designees. Perhaps your spouse has already passed on, or maybe your spouse's net worth exceeds the current federal estate tax exclusion. While the estate tax exclusion was repealed for 2010 (meaning there are no limits for this tax year), it is slated to resume in 2011 at a threshold of $1,000,000. If your spouse's net worth exceeds that limit, it may be wise to select another individual — say a child, another relative, or a friend — to receive your assets upon your death.<br />

Keep in mind, your gift may come at a price. Those who inherit your account will be assessed income tax on the amount you leave them. Of course, Uncle Sam would not hit a beneficiary in a lower federal income tax bracket as hard.<br />

Once you name a beneficiary, you may want to review your selection from time to time, perhaps at major life changes like marriage, divorce, or the birth of a child. As your situation changes, you may find that a new beneficiary is appropriate. <o:p></o:p></span></div>
